Terms of Service

These Terms of Service ("Terms") govern your use of the Pulsem8 mobile application ("App") operated by Pulsem8 ("we," "our," or "us"). By creating an account or using the App, you agree to be bound by these Terms.

1. Service Description

Pulsem8 is a trading psychology and behavioral analytics application that:

• Monitors heart rate data from wearable devices (Apple Watch, Fitbit, Garmin) to detect emotional tilt in real-time.
• Connects to trading platforms (MT4, MT5, cTrader, NinjaTrader) via read-only API access to analyze trade history and patterns.
• Provides AI-powered coaching and voice coaching to help traders manage emotions and avoid destructive trading behavior.
• Tracks emotional self-reports, journaling, and behavioral patterns over time.

2. Account Requirements

• You must be at least 18 years of age to create an account and use the App.
• You must provide a valid email address.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate and complete information when creating your account.
• You may not create multiple accounts or share your account with others.

3. Subscription Terms

Plans & Pricing

• Pro Plan: $24.99/month
• Elite Plan: $39.99/month

All plans include a 5-day free trial. You will not be charged during the trial period.

Billing

• Subscriptions are billed monthly and auto-renew unless cancelled.
• Payment is processed through the Apple App Store (iOS) or Google Play Store (Android).
• Your subscription will automatically renew at the end of each billing period at the then-current price.

Cancellation

• You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings.
• Cancellation takes effect at the end of your current billing period. You will retain access until then.
• We do not provide refunds for partial billing periods. Refund requests must be directed to Apple or Google per their respective policies.

4. Not Financial Advice

• Pulsem8 is designed to help you understand your emotional and physiological patterns while trading.
• All trading decisions are made solely by you. Pulsem8 does not recommend when to trade, what to trade, or how much to trade.
• AI coaching is focused on emotional awareness and behavioral patterns, not financial strategy.
• You should consult a qualified financial advisor for investment advice.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• Pulsem8 is not responsible for any trading losses, whether or not you used the App before, during, or after placing trades.
• We make no guarantees that the App will improve your trading performance or prevent losses.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total aggregate liability for any claims arising from your use of the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
• We are not responsible for the accuracy of heart rate data from wearable devices, trade data from trading platforms, or AI coaching suggestions.
• We are not responsible for any actions you take or fail to take based on information provided by the App.

6. Read-Only Access & Data Security

• Pulsem8 connects to trading platforms using read-only investor passwords or equivalent read-only API credentials.
• We have no ability to execute, modify, or cancel trades on your trading accounts.
• Trading platform credentials are encrypted with AES-256 before storage.
• You may disconnect your trading platform at any time from within the App.
• You are responsible for ensuring you provide read-only (investor) credentials, not master credentials.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse-engineer, decompile, disassemble, or otherwise derive source code from the App.
• Interfere with or disrupt the App's infrastructure, servers, or networks.
• Attempt to gain unauthorized access to other users' accounts or data.
• Use automated scripts, bots, or scrapers to access or interact with the App.
• Resell, sublicense, or redistribute the App or any of its features.
• Misrepresent your identity or impersonate another person.
• Use the App to develop a competing product or service.

8. Intellectual Property

• The App, including all code, design, content, algorithms, tilt detection models, and AI coaching systems, is the exclusive intellectual property of Pulsem8.
• The Pulsem8 name, logo, and branding are trademarks of Pulsem8.
• Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial trading purposes.
• You retain ownership of your personal data (trade history, journals, self-reports). By using the App, you grant us a limited license to process this data to provide our services.

9. Termination

• You may terminate your account at any time by deleting your account within the App or by contacting support@pulsem8.app.
• We reserve the right to suspend or terminate your account if you violate these Terms, with or without notice.
• Upon termination, your right to use the App ceases immediately.
• All data associated with your account will be deleted within 30 days of account termination, in accordance with our Privacy Policy.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• Heart rate data, tilt detection, or AI coaching will be accurate or reliable.
• The App will meet your specific requirements or expectations.
• Any defects in the App will be corrected.

11. Indemnification

You agree to indemnify, defend, and hold harmless Pulsem8 and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App.
• Your violation of these Terms.
• Your trading activities, regardless of whether the App was used in connection with such activities.
• Any breach of your representations or warranties.

12. Governing Law & Dispute Resolution

• These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
• Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
• You agree to waive your right to participate in a class action lawsuit or class-wide arbitration.
• Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting updated Terms in the App and updating the "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the updated Terms. If you disagree with any changes, your sole remedy is to stop using the App and delete your account.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pulsem8 regarding your use of the App, and supersede all prior agreements and understandings.
